The limits of literal translation in contract work
Every legal system has developed its own vocabulary for fundamental contractual concepts. ‘Consideration’ in English contract law has no direct equivalent in Belgian or French civil law. ‘Force majeure’ in a civil law context carries more precise obligations than the same term in a common law contract. ‘Termination for convenience’ means different things under Belgian and English employment law. The translator cannot render these terms literally: they must identify the functional equivalent in the target legal system, or explain where no equivalent exists.
