Terms and Conditions

1. Purpose

These general terms and conditions govern the relationship between the client (“you”) and BETRANSLATED INTERNATIONAL (“we”). Signature at the bottom of this document implies unconditional and irrevocable acceptance of these general terms and conditions by the client, who acknowledges having read them in full.

2. Priority

Our general terms and conditions take precedence over those of the client, which the client waives, except in specific circumstances clearly defined.

3. Liability

a. Of the translation agency
We cannot be held liable for any delay in the execution of work due to illness, accident, incapacity for work, or force majeure. We also disclaim any liability in the event of a delay resulting from late delivery of the source text, whether by the client or a third party (postal service, courier company, etc.), damage to the source text and/or the translation itself, or loss of either document during transport. The same applies if the client fails to provide the information required to commence or complete the translation in a timely manner. We accept no liability for defects in the text provided by the client. We nevertheless undertake to inform the client of any potential delay as soon as possible. Finally, we accept responsibility for the quality of the translation carried out, provided it is used in its entirety and without any modification. In all cases, our liability is limited to an amount equivalent to the value of the invoice, excluding VAT, for the assignment in question.

b. Of the client
The client shall provide us, prior to or during the execution of the assignment, with all information necessary for its proper completion.

4. Professional secrecy

We are bound by professional secrecy. This implies confidentiality regarding the identity of the principal, the content of the source text, and the translation itself.

5. Rates

Applicable rates are stated in writing in the order confirmation. All amounts indicated are exclusive of VAT, unless expressly stated otherwise.

6. Delivery time

The delivery time is agreed in writing with the client. This period commences upon receipt of both the source text and the final confirmation of the assignment.

7. Execution of the assignment

We reserve the right to engage a third party for the execution of an assignment, without prejudice to our responsibility for confidential handling and proper completion of the assignment.

8. Cancellation of the assignment

An assignment may be cancelled unilaterally by the client, either before or during the translation process. If the assignment is cancelled before any work has been carried out, the client shall not be liable for any charges. For work in progress, compensation corresponding to the work already completed shall be due from the client.

9. Complaints

On pain of nullity, any complaint concerning the nature, subject matter, and/or amount of our services must be notified in writing by registered post within 10 working days of the delivery date of the translation. Any translation not contested within this period shall be deemed accepted by the client. A complaint does not suspend the payment deadline. A complaint regarding non-conformity of an assignment must be rigorously substantiated by means of dictionaries, glossaries, and/or an equivalent text written by a competent native speaker. Unjustified rejection of a translation cannot, under any circumstances, constitute grounds for non-payment of the invoice. If the complaint is deemed justified, we shall improve or replace the text provided within a reasonable timeframe or, if we cannot reasonably satisfy the client’s request, we shall grant a reduction in price.

10. Payment

Unless otherwise stated on the invoice, invoices from BETRANSLATED INTERNATIONAL are payable in euros within 15 calendar days from the invoice date. Any sum not paid within this period shall automatically and without prior notice accrue interest calculated at a rate of 8% per annum. A penalty clause of 12% of the amount due, with a minimum of €125, shall also apply. Furthermore, debt recovery costs shall be borne by the debtor. In the event of non-payment or late payment, BETRANSLATED INTERNATIONAL shall be entitled to suspend or permanently terminate its assignment, at the sole risk of the client, without any compensation being claimable by the client.

11. Disputes

Any dispute shall fall under the exclusive jurisdiction of the courts of the judicial district of Liège. Belgian law applies to the services and invoices of BETRANSLATED INTERNATIONAL.
